Define SPAM when spammers can pay for 'guaranteed delivery'

A "Spam King" has been busted and is pleading guilty:

This got me to thinking about the recent news about GoodMail, the pay-to-spam (I mean guaranteed delivery, so sorry) service that all the major ISPs just signed up for. Will GoodMail send unsolicited mail to everyone at an ISP if the sender pays for the privilege? If so, how is that different than what the "Spam King" did and is getting 11 years in prison for?
